This Policy outlines how Perth Electrical & Mechanical Services ("PEMS") manages refunds, service adjustments and payment disputes in relation to electrical, refrigeration, gas and associated works.
This Policy operates in conjunction with PEMS' Terms & Conditions.
PEMS primarily supplies:
Due to the technical and investigative nature of fault finding and repair work, services are generally time-based and non-refundable once performed.
3.1Diagnostic time is chargeable whether or not a fault is identified.
3.2Where equipment is operational at the time of attendance and no fault is reproducible, attendance remains payable.
3.3Labour already performed is not refundable.
4.1Deposits for special-order or non-stock items are non-refundable except as required by law.
4.2Capital equipment deposits are non-refundable once ordered.
4.3Refunds for parts are subject to supplier approval and may be reduced by restocking fees or freight charges.
4.4Manufacturer warranty claims are processed in accordance with manufacturer policies.
5.1PEMS may issue invoices progressively.
5.2Each attendance or stage of works is independently chargeable.
5.3Completion of all works is not required before payment of earlier stages.
6.1Where defective workmanship (as defined in clause 11.1 of the PEMS Terms & Conditions) is established, PEMS will rectify the defective workmanship in accordance with clause 11 of those Terms.
6.2Rectification is the sole remedy for proven workmanship defects.
6.3Refunds are not provided where rectification is reasonably available.
7.1If a customer disputes a payment via its financial institution, PEMS will provide evidence of:
7.2Unjustified chargebacks may result in suspension of future services.
Nothing in this Policy excludes, restricts or modifies any rights or remedies which cannot be excluded under the Australian Consumer Law.
Where liability cannot be excluded, PEMS' liability is limited to re-supply of services or payment of the cost of re-supply.
PEMS may amend this Policy from time to time. Material changes will be notified by publication of an updated version on our website with a revised effective date.
